Unlike neighboring Okaloosa to the west, Walton County has one courthouse which handles all felony and misdemeanor criminal cases, including DUI (Florida Statute 316.193) offenses. The Walton County courthouse is in DeFuniak Springs, FL. Note: There is a separate courthouse in South Walton County, but it is not used for criminal cases at the current time, despite the fact that most of the local and tourist population resides or vacations in South Walton County.

Although the county is one of Florida’s smaller counties with a population of just over 50,000 people, the population swells when thousands of vacationers visit the Emerald Coast for Spring Break or the summer tourist season. Over forty percent (40%) of the local beaches are preserved, which is rare for post-World War II Florida.

At the current time, there is one Felony (Circuit Court) judge handling felony cases and one misdemeanor (County Court) judge handling misdemeanors in the County Seat, DeFuniak Springs.

Walton County is the smallest county of the First Judicial Circuit in terms of population, and knowledge of the prosecutors, judges and local procedures is critical for your criminal defense attorney.

Courthouse Surprise

Walton County is a county where the Internet is practically useless when it comes to predicting the possible sentence one faces for a criminal offense.

For example, unrepresented people are often shocked to learn that they will be sentenced to jail time for a first offense DUI when they have no prior record. Florida Criminal Law always resembles a minefield, but in small, rural counties such as Walton, courthouse surprise awaits the unwary – especially tourists relying on Internet websites designed for South Florida law firms.

Walton County is unique, and dangerous for the unwary, especially if they are unrepresented in criminal court, whether felony or misdemeanor.
