When you are involved in a criminal case as a family member or as a defendant, it’s very easy for your emotions to run away with you. Often you feel like you’re in that old cartoon, where the devil is poking someone standing in front of two doors. One of the doors says “Damned if you do” and the other one says “Damned if you don’t.” It’s not much fun to have a painful plea offer with the risk of a painful outcome at trial that’s many magnitudes worse. When you’re dealing with this, it’s critically important to make your decision as if you were advising someone else. In other words, if you were sitting on the jury and didn’t know anybody involved, how would you vote based on the evidence? When you consider the case from this perspective, it is as if a light bulb suddenly illuminates a dark room; everything becomes very clear.

However, if you analyze a plea offer, a defensive strategy or any other aspects of a criminal case from the personal perspective of what happens to me or someone I love, then the logical analysis is invariably going to be flawed because of the personal bias and personal interest in the outcome. This third person perspective is absolutely essential when it comes to deciding whether or not to accept a plea bargain and whether or not to testify. This perspective frees people from the tremendous pain that results from clouded judgment. Clouded judgment is probably the single number one cause of extremely adverse and bad outcomes in criminal courtrooms. When people have clouded judgments and they’re not analyzing factual information in a logical and reasonable manner, then the risk of stepping on a legal landmine in the field of Florida criminal law is very high. We don’t want you to step on a legal landmine and blow up your life. If you follow all of the steps that I have recommended, then you will have the highest degree of likelihood of success in your criminal case.
