What Is Sexual Battery in Florida?

Sexual battery is laid out in Florida Statute Section 794.011. This law defines it as “oral, anal, or female genital penetration” that is committed against the alleged victim’s will. It can also be committed by using any type of object. 

The circumstances and ages of the parties involved will determine how it is charged as follows:

If the alleged offender is 18 or older while the victim is less than 12, it is charged as a capital felony. This act includes injuring the sexual organs of the victim as well in the attempt to commit the crime. It carries the penalty of life in prison with a minimum of 25 years served before becoming eligible for parole. 

In other sexual battery crimes, the age of the alleged victim and other aggravating factors can also affect how you are charged and the penalties you will face. For example, if the alleged victim is aged 12 to 18, you will face a life felony that carries a lifetime prison sentence and/or a fine of up to $15,000. 

If the sexual battery is committed with aggravating factors, you will face a first-degree felony carrying up to 30 years in prison and/or a fine of up to $10,000. 

Aggravating factors can include: 

  • The victim was physically helpless
  • The victim was mentally incapacitated 
  • The offender was someone who was in a position of authority over the alleged victim
  • The offender used threats of violence against the victim that caused or might have caused great bodily harm
  • The offender used drugs or other substances to incapacitate the victim

Without physical force, sexual battery is a second-degree felony punishable by a fine of up to $10,000 and up to 15 years in prison. 

The other factor that can affect charging and sentencing in a sexual battery case is your previous criminal record.
