Child Pornography Cases in Florida

Possession, distribution, transmittal, and manufacture of visual depictions of child pornography images are covered under Florida laws 847.0135, 847.0138, and 827.071.  Each image of child pornography that you are found with is charged separately as a third-degree felony which is punishable by up to five years in prison and a fine of up to $5,000. You may also face a term of probation which may involve a no-contact order with minors under 18 unless supervised by an adult and/or being prohibited from using the internet for anything but business purposes. You may also face mandatory attendance at a sex offender education program and be required to register as a sex offender in Florida. 

This means that the prosecutor has the discretion of making multiple charges of child pornography based on the number of images found in your possession. The sentences for these charges could also be run consecutively, meaning one after the other, putting you in prison for decades. 

Additionally, exposing a minor to pornography is also illegal in Florida. It is charged as a first-degree misdemeanor carrying up to a year in jail and a fine of up to $1,000. 

Possession and distribution of child pornography at the federal level can put you at risk for a maximum prison sentence of 15 years and a fine of up to $10,000. 

Under federal law, if you are found to have exploited minors in any child pornography offense, you may face a maximum of up to 30 years in prison.
