What Is Capital Sexual Battery in Florida?

Capital sexual battery is defined under Florida Statute 794.11. Under this law, it is committed when a person 18 years old or older engages in sexual battery against a child aged 12 or younger or when the offender injures the sexual organs of such a child by attempting to commit this offense. According to the law, a sexual battery consists of oral, anal, or female genital penetration done through the offender’s sexual organs or with an object. 

This crime is punishable by life imprisonment or by the death penalty.
