Florida Resisting Arrest Lawyer

Many encounters with the police do not go as well as people would like. While many police officers treat the citizens they encounter respectfully and follow the law that they have sworn to uphold, many do not. Sometimes, when law enforcement officers believe that their authority is being challenged, they may escalate a situation and place someone under arrest for resisting arrest even when there was no underlying crime. Additionally, in some cases, law enforcement can engage in outright lying in order to justify an arrest on an individual whom they suspected a crime they later determined had not occurred. Resisting arrest is a serious crime in Florida and can result in significant legal sanctions. In some cases, a conviction could affect you for years, potentially affecting your ability to obtain employment or your reputation in the community. As a result, it is extremely important for anyone accused of resisting arrest in Florida to discuss their options with an experienced Florida criminal defense lawyer as soon as possible. To schedule a free consultation with criminal defense specialist Stephen G. Cobb, call our office at (850) 669-5882.

What is “resisting arrest” in Florida?

The term “resisting arrest” covers a broad range of conduct outlined in Chapter 843 of the Florida Statutes. Section 843.01 defines resisting an officer with violence, while 843.02 defines resisting an officer without violence. Of course, resisting an officer with violence is the more serious offense, but cases involving resisting without violence may be more arbitrarily imposed by law enforcement officers who need to justify an unlawful arrest. Below is some information regarding the maximum penalties for each offense:

Resisting an Officer without Violence:

  • Up to one year in jail
  • A fine of up to $1000

Resisting Arrest with Violence:

  • Up to five years in prison
  • Fines of up to $5,000

In both cases, a judge has the discretion to order a less serious sentence, so the assistance of an attorney is extremely important for anyone facing allegations of either type of resisting arrest in Florida.
