Defending A Wide Range Of Fraud Cases

Florida’s Fraud statute is enormous and contains four separate categories of fraud crimes. These categories include general frauds and false pretenses, credit card fraud, credit services fraud, and credit counseling fraud. In the first section, the heading of “General fraud” may include the following acts:

  • False statements to obtain property or services
  • Fraudulent insurance claims (however, false advertising by insurance companies is legal)
  • Altered books by individuals or corporations
  • Communications fraud
  • False impersonation to obtain a financial benefit of some kind
  • Misleading advertising
  • Event ticket fraud
  • Mortgage fraud
  • Fraudulent use or possession of personal identification information
  • Fraudulent subleasing of a motor vehicle
  • Fraudulent imitation controlled substances

The second section of the statute—credit card fraud—is the most commonly prosecuted type of fraud and also may involve various types of schemes or actions, such as identity theft, theft of property, and more. There is also a catch-all known simply as “scheme to defraud” which can encompass any number of acts that are not specifically addressed in other parts of the law.
